To prepare students for entry level jobs or additional education in the business industry.

Benchmark 1

Agency and Employment - Agency

Indicator 1

The student will distinguish between an agent and individuals, such as independent contractors, real estate brokers, bailees, and trustees.

Indicator 2

The student will distinguish between a general power of attorney and a limited power of attorney.

Indicator 3

The student will explain the different types of agents.

Benchmark 2

Agency and Employment - Employment

Indicator 1

The student will explain the relationship of Title VII of the Civil Rights Act to employment.

Indicator 2

The student will determine what questions can and cannot be asked during an employment interview.

Indicator 3

The student will demonstrate an understanding of the basis on which employees or applicants may be asked to take tests, such as aptitude, psychological, polygraph, and drug tests.

Indicator 4

The student will identify other legislation that regulates employee rights, such as the Americans with Disabilities Act, the Age Discrimination in Employment Act, and the Family and Medical Leave Act.

Indicator 5

The student will identify legislation that regulates employment conditions, such as the Fair Labor Standards Act, the Immigration Reform and Control Act, and the Occupational Safety and Health Act.

Indicator 6

The student will determine legislation which guarantees worker benefits, such as unemployment insurance legislation, pension protection legislation, workers compensation legislation, and social security legislation.

Indicator 7

The student will describe the collective bargaining process.

Indicator 8

The student will identify legislation that regulates union activities, such as the National Labor Relations Act, the Taft Hartley Act, and the Landrum-Griffin Act.

Business Organizations - Sole Proprietorships and Partnerships

Indicator 1

The student will outline the legal procedures for forming and running a sole proprietorship.

Indicator 2

The student will explain the property rights involved in partnerships, such as tenancy in partnership and sharing of profits.

Indicator 3

The student will identify how the partnership may be dissolved by the acts of the partners, operation of the law, and by order of the court.

Indicator 4

The student will distinguish a limited partnership from a general partnership.

Indicator 5

The student will explain the rights and duties of limited partners and general partners in a limited partnership.

Indicator 6

The student will explain the distribution of assets after the dissolution of a limited partnership.

Benchmark 4

Business Organizations - Corporations

Indicator 1

The student will differentiate among types of Corporations, such as profit, non-profit, domestic, foreign and S corporations.

Indicator 2

The student will explain the steps in forming a corporation.

Indicator 3

The student will explain the circumstances under which the courts may "pierce the corporate veil".

Indicator 4

The student will describe the functions of the board of directors and officers of a corporation with regard to control of corporate affairs.

Indicator 5

The student will differentiate among types of stock, such as common and preferred.

Indicator 6

The student will identify shareholder rights, such as the right to receive dividends the right to vote, the right to inspect books, and pre-emptive rights.

Indicator 7

The student will describe when promoters, directors, and officers are liable to the corporation, shareholders, and third persons.

Business Organizations - Limited Liability Corporations

Indicator 1

The student will explain the steps in forming a limited liability corporation.

Indicator 2

The student will explain the advantages and disadvantages of doing business as a limited liability corporation.

Indicator 3

The student will explain the nature of management responsibilities in a limited liability corporation.

Benchmark 6

Property Law - Personal Property

Indicator 1

The student will identify the forms of co-ownership of personal property.

Indicator 2

The student will explain how a bailment is created and describe the standard of care different bailees are required to exercise over bailed property.

Indicator 3

The student will distinguish between an ordinary bailment and a special bailment.

Indicator 4

The student will define intellectual property and list types of intellectual property.

Indicator 5

The student will identify a common carrier's liability for loss or damage to goods.

Benchmark 7

Property Law - Real Property

Indicator 1

The student will distinguish among liens, licenses, and easements and explain the differences.

Indicator 2

The student will list the major estates in land and describe the major features of each.

Indicator 3

The student will list and describe the forms of co-ownership of real property.

Indicator 4

The student will illustrate the method of transferring title (deeding) to real property.

Indicator 5

The student will describe the kinds of rental relationships that landlords and tenants may create.

Benchmark 8

Commercial Paper

Indicator 1

The student will identify and explain the essential elements of a negotiable instrument.

Indicator 2

The student will describe the different types of negotiable instruments and different types of endorsements.

Indicator 3

The student will explain the contractual relationship between the bank and its customers.

Indicator 4

The student will describe stop-payment orders.

Benchmark 9

Computer Technology

Indicator 1

The student will prepare a computerized spreadsheet to analyze and present data.

Indicator 2

The student will prepare graphic presentations of data by computer.

Indicator 3

The student will incorporate graphic presentation of data in a printed document.
